Is it a legit copy of GTA or pirated?

Delete the gta_sa.set file from the User Files folder and it should work.

As Trevor Dawson stated go to My Documents -> GTA SA User Files -> delete the file "GTA_SA.set"
Doing this will restore default GTA SA settings to what they were the first time you launched it, and could help fix your issue.

I didn't launch it so there is no GTA_SA.set File

Alright, are you using a laptop/netbook? If so, try to launch the game on an external display, like a monitor, if you can.

Have you tried turning it on then off? HUEHUEUHUEHUE
No. But really.
Try to reinstall Grand Theft Auto. If it is a legit copy, pop in the CD and reinstall it.
What is your screen size?

Found this solution on gta forums, try it and let us know if it works.
For your computer monitor, Try:
Windows START button > Control Panel > Appearance and Personalization > Adjust screen resolution > (make your personal selections here).
Also, i suggest you download this patch and install it, try running the game afterwards.
